Recently, the Delhi High Court refused to consider an application from Shifa ur-Rehman seeking an expedited hearing of his appeal regarding the denial of bail in a case under the Unlawful Activities (Prevention) Act (UAPA) connected to the 2020 Delhi riots.
A Bench comprising Justices Navin Chawla and Shalinder Kaur noted that the appeal is scheduled for hearing on November 25.
“Keeping in view the nature of this Board, it is not possible to accede to this request...The appeal is already listed for hearing on 25.11.2024, when an endeavour will be made to hear the same,” the Court ordered.
Rehman's appeal is associated with those filed by Umar Khalid and Sharjeel Imam, all of which are set to be heard by the Court on November 25.
During the course of hearing, Reham was represented by Advocates Bilal A. Khan and Anshu Kapoor.
On the other hand, Special Public Prosecutor Amit Prasad, along with Advocates Ruchika Prasad, Ayodhya Prasad, and Chanya Jaitly, represented the State in the proceedings.
Case Brief:
Earlier, Rehman served as the President of the Alumni Association of Jamia Millia Islamia (AAJMI). He was arrested by the Delhi Police in April 2020 and accused of inciting communal violence that erupted during protests against the Citizenship Amendment Act (CAA).
During his bail hearing before the sessions judge, Rehman's counsel contended that the right to peaceful protest is a fundamental right, asserting that Rehman was a protester rather than a rioter.
