The Delhi High Court issued a directive on Thursday, instructing the Delhi Police to submit a status report regarding a petition that urges legal action against Congress leader Rahul Gandhi. This petition alleges that he disclosed the identity of a 9-year-old Dalit girl who tragically faced rape and murder at a crematorium in Delhi.
A Division Bench of Acting Chief Justice Manmohan and Justice Mini Pushkarna ordered the Police to file a report in 10 days.
The Court was addressing a Public Interest Litigation (PIL) filed by activist Makrand Suresh Mhadlekar, expressing concern about Gandhi's tweets. These tweets included images of the parents of the deceased girl, which drew objections in the context of the case.
Mhadlekar pointed out that these photographs could potentially disclose the identity of the victimized girl, thus violating the Juvenile Justice (Care and Protection of Children) Act (JJ Act) and the Protection of Children from Sexual Offences Act, 2012 (POCSO Act).
He emphasized that according to Section 74 of the Juvenile Justice Act and Section 23(2) of the POCSO Act, it's mandatory to safeguard the identity of the victim and her family members. Today, both the counsel representing the petitioner and the National Commission for Protection of Child Rights (NCPCR) informed the Bench that despite the incident occurring nearly three years ago, no action has been initiated by the Delhi Police.
The lawyer representing the National Commission for Protection of Child Rights (NCPCR) asserted that it is imperative for the Delhi Police to register a First Information Report (FIR) in this particular case.
Meanwhile, Advocate Tarannum Cheema appeared for Gandhi and told the Bench that the Court has not issued formal notice to him.
The Bench said that it will first examine the status report of the Delhi Police and then decide what needs to be done.
