Delhi Court Frames Sexual Harassment Charges Against BJP MP Brij Bhushan Sharan Singh

A Delhi court on Friday formally accused Bharatiya Janata Party (BJP) Member of Parliament (MP) Brij Bhushan Sharan Singh of sexual harassment and violating the dignity of women. The charges stem from allegations of misconduct against five female wrestlers.

The order was issued by Additional Chief Metropolitan Magistrate Priyanka Rajpoot of the Rouse Avenue Court.

The court also noted that there is substantial evidence on record to proceed with charges against Singh for the offense punishable under Section 506(1) (criminal intimidation) of the Indian Penal Code (IPC) in relation to two wrestlers.

The Court clarified that regarding Victim No. 6, Accused No. 1 Brij Bhushan Sharan Singh has been discharged from the case. Additionally, the Court proceeded to charge co-accused Vinod Tomar with the offense of criminal intimidation concerning the allegations involving Victim No. 1.

Former assistant secretary of the WFI, Vinod Tomar, has been accused of criminal intimidation in relation to the allegations made by one of the six wrestlers who lodged complaints of sexual harassment against Singh. These complaints led to the registration of a First Information Report (FIR) against the Member of Parliament.

On June 15, 2023, the police filed a chargesheet against Singh, citing offenses under Sections 354 (outraging modesty), 354A (sexually colored remarks), 354D (stalking), and 506(1) (criminal intimidation) of the Indian Penal Code (IPC).

Prior to this, the complainants had approached the Supreme Court seeking the registration of an FIR against Singh. Following this, the Delhi Police informed the Supreme Court that an FIR had been registered and that the investigation was progressing as per protocol.

A minor wrestler had initially leveled allegations against Singh. However, she later withdrew her complaint, leading the Delhi Police to file a cancellation report in that case under the Protection of Children from Sexual Offences Act (POCSO Act).

Significantly, on April 26, the court had dismissed an application filed by Singh requesting further investigation in the case. Singh had claimed that he was not in Delhi at the time when one of the wrestlers alleged the incident occurred.
