On Tuesday, a Delhi Court granted a one-day extension of police custody for AAP MLA Naresh Balyan in connection with an extortion case filed last year.
The order was passed by Additional Chief Metropolitan Magistrate Paras Dalal after the Delhi Police filed a request seeking two more days of custody for Balyan, who represents Delhi's Uttam Nagar Assembly constituency.
The court also directed the police to respond to a bail application submitted by Balyan, issuing a notice to the Delhi Police with a deadline of Wednesday for their reply. Balyan is scheduled to appear in court on the same day.
The police argued that Balyan had been uncooperative during the investigation and that further custodial interrogation was necessary to uncover the conspiracy and potential involvement of others in the alleged "extortion syndicate."
Balyan’s defense counsel, however, called the arrest "illegal" and politically motivated, claiming that the grounds for the arrest were not provided to the accused in writing at the time of his detention.
Balyan was arrested by the Delhi Police Crime Branch on Saturday following the release of an audio clip that allegedly featured a conversation between the MLA and a gangster.
