During the hearing at Rouse Avenue Court, Kejriwal's legal team argued against the CBI's arrest, claiming bias in their sudden shift from treating him as a witness to an accused. Kejriwal also requested a 24-hour deferral of the hearing to review the CBI's case.

Since being granted regular bail by the Rouse Avenue Court recently, Kejriwal's legal fortunes have been eventful. The ED challenged this bail in the High Court, which temporarily stayed it pending further review. The subsequent move to appeal this stay at the Supreme Court was declined, with the court terming the sequence of events as unusual but declining interference until the lower court's full order was on record.
Ultimately, the High Court revoked Kejriwal's bail, criticizing the lower court's handling of the bail application and pointing out legal lapses. This decision means Kejriwal remains in custody following his earlier arrest by the ED in March.
