Delhi Chief Minister Arvind Kejriwal withdrew his petition from the Supreme Court on Wednesday (June 26). This petition challenged the Delhi High Court's June 21 order, which had temporarily halted the implementation of a lower court's June 20 decision granting him bail in a money laundering case linked to the alleged Delhi liquor policy.
Kejriwal's lawyer, Senior Advocate Dr. Abhishek Manu Singhvi, informed the Court that on June 25, the Delhi High Court issued its final order on the ED's stay application and provided the rationale behind suspending the bail order. Given these developments, Singhvi stated that the current petition is being withdrawn to prepare a new petition challenging both the June 25 and June 21 orders of the Delhi High Court.
Granting Kejriwal the liberty to file a fresh petition, a Vacation Bench comprising Justices Manoj Misra and SVN Bhatti dismissed the current petition as withdrawn.
Singhvi further informed the bench that today, the CBI has also arrested Kejriwal in connection with the case.
On June 21, the Delhi High Court issued an interim stay against the implementation of the trial court's bail order granted to Delhi's Chief Minister in the liquor policy case. During this decision, the Court reserved its final judgment on the Enforcement Directorate's stay application. Shortly afterward, the AAP leader challenged this decision before the Supreme Court.
Describing the Delhi High Court's decision to reserve its order on the ED's stay application against Arvind Kejriwal's bail as "unusual," the Supreme Court listed the matter for today (June 24). The Court emphasized that it did not intend to "pre-judge" the issue while awaiting the High Court's final decision.
Yesterday, in its final order, the Delhi High Court granted the Enforcement Directorate's application and suspended the bail granted by the trial court. Justice Sudhir Kumar Jain noted that the Vacation Judge had issued the bail order without thoroughly examining the ED's complete evidence, highlighting what he described as "perversity" in the initial decision.
Kejriwal was arrested by the Enforcement Directorate (ED) on March 21. In May, he was granted interim bail by the Supreme Court till June 01 in view of general elections. He surrendered on June 2.
