Justice P.S. Narasimha, a Supreme Court judge, recently stated that courts have been taking proactive measures to ensure the implementation of laws instead of merely declaring and enforcing them through judgments.
He made these remarks during an awareness workshop on online child sexual exploitation and abuse. According to Justice Narasimha, the judiciary is now undertaking the necessary steps following the enactment of laws by Parliament.
Traditionally, the role of the courts has been limited to decision-making, while Parliament formulates laws and outlines the corresponding offenses.
However, Justice Narasimha observed a shift in the court's approach in recent years. Rather than solely focusing on interpreting and enforcing the law through judgments, the judiciary has adopted a proactive stance. This proactive approach is evident in areas such as arbitration laws, mediation, and juvenile justice.
Justice Narasimha emphasized that courts play a pivotal role as stakeholders in the justice delivery system. The workshop was attended by Chief Justice Satish Chandra Sharma of the Delhi High Court, other judges from the high court, and Delhi Police Commissioner Sanjay Arora.
