Recently, the Bombay HC refused to stay release of the Bollywood movie- Dream Girl 2 in response to a copyright infringement lawsuit filed by an individual.
The single-hedaed bench of Justice Riyaz Iqbal Chagla heard all parties involved, including the film's writers Raaj Shaandilyaa of Think Ink Picturez Ltd and Naresh Kathooria.
The film, starring Ayushmann Khurrana, was scheduled for release on the following Friday. Justice RI Chagla, a single-judge, ruled that preventing films from being released at the last moment should be avoided.
"The interim application has only been filed on 18th August, 2023. The Respondents have not had an opportunity to reply to the interim application. It is well settled that at the eleventh hour, films should not be prevented from their release. An opportunity is required to be given to the Respondent / Defendant to file their reply to the interim application," said the Court
Ashim Bagchi filed a copyright suit, alleging that the storyline of the film closely resembled a script he had registered with the Film Screen Writers Association in May 2007. He mentioned that he made a minor alteration to the script's title and re-registered it. After viewing the trailer of "Dream Girl 2" on August 1, Bagchi claimed to have noticed several similarities in the plot and character depictions.
Bagchi sent notice to the production company Balaji Telefilms, including directors Ekta Kapoor and Shobha Kapoor.
When there was no response, he filed a commercial suit in the High Court on August 18, seeking an order to stay the film's release until the copyright suit was resolved.
He granted the respondents time to file their responses to the application and scheduled the final hearing for August 30. However, he declined to grant a stay on the film's release.
