Consumer Commission Orders OYO to Refund ₹3,461 for Dishonoured Hotel Booking

The District Consumer Disputes Redressal Commission in Gurgaon has recently ruled in favor of a customer, instructing hospitality giant OYO to provide a complete reimbursement of ₹3,461. This decision was made after the hotel booked by the customer for a three-day stay failed to honor the reservation for one of those days.

The President of the Consumer Forum, Sanjeev Jindal, along with Members Jyoti Swatch and Khushwinder Kaur, additionally directed OYO to compensate the customer, who was a lawyer booking the room for a guest. OYO was ordered to pay ₹25,000 in damages and ₹11,000 to cover litigation expenses.

In December 2021, advocate Vibhor Aggarwal reserved a room at 'Hotel New Sunshine' for his guest, spanning three nights from December 30, 2021, to January 2, 2022.

Despite the confirmation of the booking, the hotel refused accommodation for December 31, citing full reservation for the day. Consequently, Aggarwal, the complainant, was compelled to arrange alternative accommodation for his guest on December 31, 2021. Due to the inconvenience and trouble caused by the hotel's actions, Aggarwal issued a legal notice to OYO, demanding a full refund and damages amounting to ₹50,000. However, as OYO agreed to reimburse only for one day, the complainant escalated the matter to the consumer forum.

The consumer forum mentioned that the claims presented by the complainant were substantiated by precise and concise documentary evidence provided by him. Based on this evidence, the forum determined that OYO's failure to deliver the expected service was indisputably established.

As a result, the consumer forum chose to disregard OYO's defense, which argued that the complainant had no valid cause of action or that there was no deficiency in the service provided by the company.

Therefore, the consumer forum found OYO responsible for inadequately serving the complainant and granted his plea, along with associated costs.

The complainant, Vibhor Aggarwal, was present in person along with advocate Bhupinder Yadav, while OYO was represented by advocate Sandeep Yadav.
