The District Consumer Disputes Redressal Commission in Thrissur, Kerala, has issued a ruling directing Britannia Industries and a local bakery to compensate a consumer with ₹60,000. The compensation stems from the sale of biscuit packets weighing 52 grams less than the advertised 300 grams.
The commission, led by President C T Sabu and members Sreeja S and Ram Mohan R, noted a significant shortfall in weight compared to the declared quantity on the packaging.
The ruling, dated September 26, 2023, followed a complaint by George Thattil, who purchased two packets of Britannia Nutri Choice Thin Arrow Root Biscuits for ₹40 each.
Despite the packaging indicating a weight of 300 grams, the packets actually weighed 268 grams and 248 grams,, respectively, prompting the consumer to file a complaint. Despite being served notices, both Britannia and the bakery failed to provide written statements.
Consequently, the commission proceeded ex-parte and found both parties guilty of unfair trade practices, violating consumer rights. The commission ordered ₹50,000 as compensation for the complainant's losses and ₹10,000 towards litigation costs.
Additionally, the Controller of Legal Metrology of Kerala was directed to conduct a statewide investigation to ensure compliance with net quantity regulations for packaged goods. Advocate AD Benny represented the petitioner in the case.
