Cine1 Studios Seeks Delhi HC Intervention to Halt OTT Release of Ranbir Kapoor's Film 'Animal'

Cine1 Studios, a production company asserting its role as one of the producers of the movie Animal featuring Ranbir Kapoor, has filed a petition with the Delhi High Court seeking an injunction to halt the film's release on Over-the-Top (OTT) platforms.

In 2023, the film "Animal," directed by Sandeep Reddy Vanga, achieved significant commercial success, ranking among the highest-grossing movies of the year.

Cine1 Studios Private Limited has initiated legal action against Super Cassettes Industries Private Limited (T-Series), contending that the two production companies had entered into a contractual agreement for the production of the film. According to the terms of this agreement, Cine1 Studios asserts a 35 percent profit share and claims entitlement to 35 percent of the intellectual property rights associated with the movie Animal.

The legal action claims that Super Cassettes Industries Private Limited (T-Series) incurred expenses for the production, promotion, and release of the film "Animal" without obtaining approval from Cine1 Studios. Furthermore, T-Series allegedly received revenues from box office sales without providing any details of the earnings, and despite the profit-sharing agreement, failed to make any payments to the plaintiff (Cine1 Studios).

Justice Sanjeev Narula heard the matter today.

During the legal proceedings, Senior Advocate Sandeep Sethi, representing Cine1 Studios, asserted that the production house had not received any communication or notification regarding the film's revenues, box office collections, as well as rights related to music, satellite, or the internet. This lack of information is presented as a grievance in the case.
 
In the legal representation for T-Series, Senior Advocate Amit Sibal contended that Cine1 Studios lacks a financial stake in the matter, emphasizing that the production house has not made any monetary investments in the film. Sibal argued that without a financial contribution, Cine1 Studios does not have a substantial interest or "skin in the game" concerning the movie.
 
Senior Advocate Amit Sibal referred to an amendment dated August 2, 2022, made to the initial contract. According to Sibal, in this amendment, Cine1 Studios purportedly relinquished all its intellectual property and derivative rights associated with the film. In exchange for this, Cine1 Studios received a payment of ₹2.6 crores. This amendment is presented as evidence that Cine1 Studios willingly gave up its rights to the movie.
 
"This amendment has been concealed. They got ₹2.6 crore. They have not put a pie in the movie and yet got ₹2.6 crores," Sibal stressed.
 
The Court examined the amendment and asked Sethi whether he had been briefed about this.
 
Cine1 Studios asserted that, despite T-Series entering into an agreement with Bhadrakali Pictures (Sandeep Reddy Vanga’s company), the relevant document outlining this arrangement was not disclosed to Cine1 Studios.
 
As a result of these claims and alleged breaches of agreement, Cine1 Studios sought an injunction to halt the release of the movie on Over-The-Top (OTT) platforms until Super Cassettes Industries Private Limited (T-Series) adheres to the terms outlined in the agreement with Cine1.
 
Cine1 Studios' request for compliance encompasses several aspects, such as delivering the agreed-upon profit share, providing due credits, disclosing the certified final production cost of the film, sharing details of box office collections, and furnishing executed agreements with Culver Max and Netflix. Additionally, Cine1 is seeking information about the agreement with Sandeep Reddy Vanga.
 
Senior Advocate Sandeep Sethi argued the case for Cine1. He was assisted by advocates Jaya Goyal, Gitika Agarwal, Parminder Singh, Arjun Agarwal, Kaushal Jeet Kait, Tejaswi Chaudary, Abhay Agnihotri, Daksh Gupta, Jatin Yadav, Gaurav Dua, Shreya Sethi and Sumer Seth.
