Calcutta HC: ED may issue fresh summons to TMC's Abhishek if documents unsatisfactory

The Calcutta High Court has ruled that if the Enforcement Directorate is not content with the documents provided by TMC MP Abhishek Banerjee concerning the alleged school jobs scam in West Bengal, they have the option to issue new summons to him.

On Wednesday, the Enforcement Directorate (ED) issued a summons to Abhishek Banerjee, asking him to appear before them on October 9. This came after he had previously missed a summons on October 3 because he was attending a TMC protest rally in New Delhi, where he demanded the immediate release of central funds owed to the state.

In response to an appeal by MP Abhishek Banerjee challenging a single bench's order that directed the Enforcement Directorate (ED) to ensure the investigation process was not disrupted on October 3, a division bench stated that the ED has the authority to establish a specific time frame for Banerjee to provide the necessary documents as per its requirements.

A division bench, with Justice Soumen Sen presiding, suggested on a Wednesday that the Enforcement Directorate (ED) could consider issuing a summons to Banerjee if they find the documents he has submitted to the investigators unsatisfactory.

The investigative agency is set to present its arguments on Thursday before the bench, which includes Justice Uday Kumar, regarding the aforementioned suggestion.

Banerjee, who underwent a nearly nine-hour interrogation by the ED in connection with the teacher recruitment scam on September 13, asserted at that time that the questioning was a deliberate effort to hinder his participation in the INDIA' meet. He viewed it as evidence of the significant role the TMC (Trinamool Congress) plays in uniting opposition parties.

The TMC MP, who has served two terms, was also subjected to questioning by the ED in the coal pilferage case on two occasions. The first interrogation took place at the agency's office in the national capital in 2021, and the second occurred in Kolkata in 2022.
