In a recent development, the Bombay High Court has granted bail to a young man in a complex case involving sexual assault allegations. The case, heard by Justice Anil Kilor, stemmed from charges filed at Pandharpur Taluka Police Station in Sangli.
The accused faced multiple serious charges under the Indian Penal Code, the SC/ST (Prevention of Atrocities) Act, 1989, and the POCSO Act 2012. Court records indicate that the accused and the minor girl had resided together in Madhavnagar, Sangli for approximately one month, during which the alleged incident occurred.
In reaching its decision, the court considered several factors.
Justice Kilor noted that both parties demonstrated sufficient maturity to understand their actions. Additionally, the court took into account that the chargesheet had already been filed and the accused had spent over a year in custody. Given the likelihood of a prolonged trial period, the court deemed bail appropriate.
The prosecution raised concerns about potential witness intimidation, citing that both parties reside in the same village. In response, the accused agreed to court-imposed conditions, including staying outside the territorial jurisdiction of Pandharpur until the trial's conclusion.
This ruling reflects the court's balance between maintaining judicial custody and considering factors such as trial timeline and the accused's willingness to comply with restrictive conditions.
