Bombay High Court grants 2 weeks Protection from Arrest to Hasan Mushrif

Yesterday, Bomay Court has granted protection from arrest to Husan Mushif for a period of 2 Days. Hasan Mushrif is connected with a probe by the Enforcement Directorate (ED). 

While giving protection, the Court directed him to remain to appear before the ED when called, following which the former minister appeared before the agency on Tuesday. Mushif approaches the Bombay High Court seeking to challenge the ED complaint claiming that it was a result of a motivated conspiracy. He further added that the central agency seemed to be in a hurry to arrest him without following due process of law.

The ED has initiated an investigation on the basis of a private complaint filed by the registrar of companies against the Sar Senapati Santaji Ghorpade Sugar Factory Limited in Pune Court, in which Mushrif’s sons are directors. Senior counsel Aabad Ponda, representing Mushrif, argued that after Mushrif was granted relief on Friday, ED officers searched his premises on Saturday morning.

Last week, the Bombay  High Court directed that no coercive action be taken against Mushrif in connection with a cheating case filed in Kolhapur against him. Counsel member also informed that there was also a stay in the proceedings on a private complaint filed by the Registrar of Companies, based on which the ED had lodged its case.

The court said that it will hear the petition in detail after four weeks.
