The Bombay High Court has issued a notice to the Maharashtra State Backward Class Commission (MSBCC) following petitions that challenge the state's implementation of a 10% reservation for Marathas in education and employment.
The full bench of the Bombay High Court, consisting of Chief Justice Devendra Upadhyaya, Justice Girish Kulkarni, and Justice Firdosh Pooniwalla, issued a notice to the Maharashtra State Backward Class Commission (MSBCC), chaired by retired High Court judge Sunil Shukre. Yesterday, Advocates Anil Anturkar and Pradeep Sancheti opposed Advocate Subhash Jha’s application seeking to involve the commission as a party respondent.
Earlier, the bench hesitated to include the commission as a party respondent. However, later on, the Court mentioned that certain petitions contested the appointment of commission members and sought to invalidate the commission's report. Recognizing the necessity for the commission to be heard on such matters, the bench decided to add it as a party respondent.
During today's hearing, Advocates Anturkar and Sancheti informed the bench that they were in agreement with adding the commission as party respondents.
The bench subsequently instructed the petitioners to amend their petitions to include the Maharashtra State Backward Class Commission as a party respondent. Furthermore, the bench issued a notice to the backward class commission, summoning them to appear on July 10th.
Furthermore, the bench granted permission to the state of Maharashtra to file any additional affidavit deemed necessary. It also allowed for a rejoinder to this additional affidavit to be filed within one week.a
