The Bombay High Court recently granted bail to 23-year-old Pune wrestler Kyle Cummings in an NDPS case. He was accused of ordering 281 grams of methamphetamine, along with MDMA tablets and powder from Belgium.
A single-judge bench of the Bombay High Court, led by Justice Manish Pitale, recently heard the bail petition of Kyle Cummings, who was arrested in May 2024 along with two others. The Sessions Court had previously rejected Cummings' bail application, citing sufficient involvement in the crime.
The Special Investigation and Intelligence Branch intercepted a parcel at a foreign post, later found to contain MDMA. The package was forwarded to Pune, where a trap was set. Shrawan Joshi, the consignee, collected the parcel and was subsequently arrested. Cummings and Aryan Haldankar were later apprehended as well.
Cummings sought bail by relying on a previous order from the division bench of the Bombay High Court, which had granted bail to Shrawan Joshi, arguing for parity in treatment.
Cummings argued that the division bench, in its order granting bail to co-accused Shrawan Joshi, had observed that Joshi's arrest and the contents of the arrest memo indicated clear violations of legal requirements. The bench had highlighted that the principles established by the Supreme Court in related cases were not followed in Joshi's case, and Cummings contended that these same violations were present in his case as well.
In response, the prosecutor argued that the case involved a commercial quantity of contraband and pointed out that Cummings' modus operandi involved ordering the contraband and substances in the name and address of co-accused Shrawan Joshi.
The bench accepted the contentions of Cummings and proceeded to grant bail. "Since the applicant herein was arrested and the arrest memo in the present case is almost identical to that executed in the context of co-accused-Shrawan Joshi, this Court is inclined to allow the application," the order reads.
