Bombay HC Grants Bail to Man Accused in Rape Case Amidst Delay and Relationship Claims

The Bombay High Court recently granted bail to a man charged with rape, who had been booked by the Kharghar Police Station.

Justice Manish Pitale, presiding over the single-judge bench, was reviewing the bail application for the accused, who faces charges under Sections 376 and 506 of the IPC.

The complainant, a 26-year-old woman, alleged that the accused, her cousin, had sexual intercourse with her without her consent. However, the applicant's counsel argued that the FIR was lodged about seven months after the alleged incident and presented call detail records showing ongoing communication between the complainant and the accused. The defense contended that the two were in a relationship and claimed that the case might be a false implication.

The Additional Public Prosecutor contended that the seriousness of the charges warranted the accused's continued custody for medical examinations and procedural requirements. Nevertheless, the high court observed that the FIR was filed after a significant delay and noted that evidence suggested continuous contact between the complainant and the accused prior to the FIR, which supported the defense's argument of a possible relationship. Consequently, the court granted bail to the accused.
