Bombay HC Extends Interim Relief for Tata-Owned Retail Giant Trent Limited, Safeguarding 'Zudio' Trademark Against Unauthorized Use

Recently, the Bombay High Court prolonged the temporary relief provided to Trent Limited, a retail company under the Tata umbrella. The court specifically directed unidentified individuals to refrain from utilizing the company's trademarked name, 'Zudio'.

A ruling was issued by Justice RI Chagla, a single-judge bench, without affording the defendants an opportunity to present their case, citing the pressing nature of the matter.

Trent Limited alleged that zudiofranchise.net and other defendants were not only utilizing the company's trademark 'Zudio' for their services but were also operating under a domain name that belonged to Trent Limited. In its order, the bench explicitly recorded its conviction that Trent Limited's trademark or artistic work associated with 'ZUDIO' holds a distinctiveness that has amassed substantial goodwill and a reputable standing. 

Trent Limited argued that the defendants were engaging in deceptive practices by employing Trent's name, address, website details, and intellectual property rights to deceive the public. They were falsely portraying an association with Trent, mimicking the company, enticing the public with fraudulent offers to establish a Zudio franchise, and collecting money under Trent's name.

Additionally, Trent Limited asserted that the defendants had defrauded multiple individuals, resulting in significant financial losses amounting to lakhs of rupees. The high court, as part of its order, instructed Tucows Domain Inc. to submit an affidavit outlining the specifics of the individual using Trent Limited's domain name.

The bench went a step further and mandated Tucows Domain Inc. to suspend the domain name until the final decision was reached in the lawsuit. Despite the initial order dated November 2nd, slated to be effective until December 18th, it was brought to the bench's attention that the directives had not been adhered to. As a result, the interim relief was extended until the forthcoming hearing date.
