The Bombay High Court has recently issued an injunction against two companies, prohibiting them from infringing upon the copyrighted packaging and label associated with Pidilite Industries' product 'Rangeela' Holi colours.
Following a motion filed by Pidilite Industries alleging copyright infringement by four companies, Single-judge Bharati Dangre issued a restraining order against Craft Vatika and Bansal Handicrafts.
The Court, in its order, directed the following:
Companies, along with their distributors, sellers, and other affiliated parties, are restrained from infringing upon Pidilite's copyrighted packaging or labels by utilizing them for packaging their own products.
They are instructed to submit an affidavit providing details regarding the quantity of stock manufactured and sold by them over the past year.
The order was issued subsequent to advocate Hiren Kamod, representing Pidilite, requesting a permanent injunction against the companies. Pidilite filed an interim application on March 16 seeking urgent relief.
Two of the four defendants, companies identified as Radha Kishan Bishan Dass Rang Rasayan and RB Dychem, have reached a settlement with Pidilite. Advocate Yatin Kochare, representing these two companies, declared that they would refrain from directly introducing their allegedly infringing products into the market.
They also pledged to instruct their sellers and distributors to promptly remove or refrain from offering the products for sale. The Court duly noted these assurances in its order.
Since the remaining two companies were not represented in court, Justice Dangre issued a temporary restraining order. The case is scheduled to be heard again on April 25th.
