Bombay HC Denies Pre-Arrest Bail to Man Accused of Transporting 1,065 kg of Beef to Ahmedabad

The Bombay High Court has recently denied the pre-arrest bail application of a man accused of transporting 1,065 kg of beef to Ahmedabad.

The application was heard by a single-judge bench led by Justice RN Laddha in the case of Yamin Yasin Qureshi, who faces charges under the Bhartiya Nyan Sanhita 2023, the Maharashtra Animal Preservation Act 1995, and the Bombay Municipal Corporation Act 1949.

On the morning of 29 July 2024, at around 4:30 a.m., the informant received confidential information about a truck transporting beef from Sangamner to Ahmedabad via the Mumbai highway at Malwani. When the informant attempted to stop the vehicle, it fled, prompting the informant to alert the police. Officers from the Kashimira Police Station soon apprehended the accused.

The vehicle was taken to a computerized weighbridge, where it was found to carry a total of 6,060 kg, including the weight of the vehicle itself, and 1,065 kg of beef without it.

Advocate Rohit Vaishya, representing the applicant, argued that Qureshi had been falsely implicated and that the allegations lacked any genuine foundation.

However, Additional Public Prosecutor Yogesh Dabke contended that the investigation was in its early stages and granting pre-arrest bail would hinder the progress of the inquiry. He also pointed out that the applicant had three prior criminal offenses of a similar nature.

The bench, while rejecting the bail application, emphasized the applicant's criminal history and expressed concern that granting bail at this stage could undermine the investigation's integrity.

“The applicant has three criminal antecedents of a similar nature. In the facts of the present case, custodial interrogation of the applicant would be necessary to uncover all aspects of the facts. In the totality of the circumstances, this Court is not persuaded by the applicant’s claim of non-involvement in the alleged crime, and prima facie, no offence under the mentioned Sections is made out. Releasing the applicant on pre-arrest bail would jeopardise the course of an effective investigation,” the order reads.
