The Bombay High Court on Wednesday questioned the Maharashtra Government about the existence of any prohibition on celebrating Tipu Sultan's birth anniversary.
A division bench of the Bombay High Court, comprising Justice Revati Mohite Dere and Justice SG Dige, was hearing a petition filed by the Pune President of the All India Majlis-e-Ittehadul Muslimeen (AIMIM).
The petitioner sought permission to celebrate the birth anniversary of Tipu Sultan on November 26, which coincides with Constitution Day, along with a commemoration of Maulana Abul Kalam Azad.
The petition was filed after the Pune Rural Police denied permission for the event. During the hearing, the bench questioned the refusal, emphasizing that there was no reason to disallow the procession since the police could impose restrictions and take necessary action in case of any law and order issues.
The Pune Rural Superintendent informed the court that incidents during last year's event had resulted in the registration of criminal cases. However, the bench clarified that the police could determine the route for the procession and take appropriate measures if disturbances occurred. It reiterated that potential law and order concerns could not be a valid ground for denying permission for the celebration.
