Bombay HC Allows Release Of Film 'Hamare Baarah'

The Bombay High Court permitted the release of the film "Hamare Baarah" on June 21, 2024, after the filmmakers consented to make specific modifications to the movie.

A division bench comprising Justice BP Colabawalla and Justice Firdosh Pooniwalla issued the order in response to a writ petition that sought to ban the film on the grounds that it is derogatory to Islam and Muslims.

"As per suggestions of the court, and which is agreeable to all the parties, the following changes will be made. The changes mentioned below shall be done before the film is released...."

The petitioner consented to withdraw objections to the film's release once the agreed-upon changes were implemented. The filmmakers agreed to remove a specific dialogue and a Quranic verse, and to include two disclaimers, each lasting 12 seconds, in the film.

The filmmakers also agreed to pay Rs. 5 lakhs to a charity chosen by the petitioner. The Central Board of Film Certification (CBFC) committed to recertify the film with the changes by June 20, 2024. The court was addressing a writ petition seeking a ban on the movie, alleging it distorted the Quran and portrayed the Muslim community in a derogatory manner.

The petition, filed by Azhar Basha Tamboli, alleges that the film, initially scheduled for release on June 7, 2024, and later postponed to June 14, 2024, completely contravenes the provisions of the Cinematograph Act, 1952, along with its associated rules and guidelines. The petition further claims that the film was wrongly certified and that its release would violate Article 19(2) and Article 25 of the Constitution.

Initially, the High Court postponed the release of the film but later permitted it after the filmmakers agreed to remove objectionable scenes. Subsequently, the petitioners approached the Supreme Court, which issued a stay on the film's release pending a final decision by the High Court.
