BJP youth wing leader seeks compensation for false implication in drugs case

Pamela Goswami, a prominent leader within the Bharatiya Janata Party's (BJP) youth wing, has taken her fight for justice to the Supreme Court. Goswami's plea comes in the wake of a prolonged legal battle, which culminated in the apex court dismissing the West Bengal government's appeal against her discharge in a high-profile drugs case.

On January 29th, the Supreme Court bench, comprising justices Vikram Nath and Satish Chandra Sharma, declined to intervene with the Calcutta High Court's ruling from March 16, 2023. This ruling exonerated Goswami from allegations of possessing cocaine, marking a significant turn in her legal ordeal.

In her plea for compensation, Goswami highlights the grievous impact of being falsely embroiled in a criminal case, asserting her innocence and victimhood in what she claims to be a malicious conspiracy. 

She asserts that she had been wrongfully detained in police custody for an extended period, from February 19, 2021, to December 10, 2021, amounting to 295 days. Goswami attributes this ordeal solely to the actions of certain individuals serving as public servants, who she contends fall under the definition of the 'State'.

Furthermore, Goswami underscores the substantial damage inflicted upon her personal and public reputation as a consequence of baseless accusations. As a prominent figure within the BJP's youth cadre, she argues that her integrity and credibility have been unjustly tarnished, causing significant distress and suffering.

The Calcutta High Court's ruling provided a critical vindication for Goswami, emphasizing that the Kolkata Police's investigation found no evidence against her. Instead, it revealed a startling revelation: another BJP leader, Rakesh Singh, allegedly orchestrated the planting of cocaine in Goswami's car out of personal animosity. The high court's verdict made it clear that Goswami had no knowledge of the contraband's presence and was not in possession of it, neither physically nor constructively.

The events leading to Goswami's legal battle unfolded in February 2021 when the New Alipore police station in Kolkata arrested her along with two others. This followed the discovery of cocaine, weighing 76 grams, in her car during a police operation.

Goswami's plea for compensation not only seeks redress for her individual suffering but also aims to hold accountable those responsible for her wrongful persecution.
