BJP leade, Adv. Ashwini Kumar Upadhyay, approaches Delhi HC, seeks direction to Law Commission to prepare comprehensive report on Uniform Judicial Code in consultation with the High Courts in order to make legal abbrivations, norms, court fees and case registar process uniform.
He also points out the differences in court fees sought for similar matters and of similar valuation in different states, which causes injury to citizens.
"Unequal court fees in different states discriminate among citizens based on their place of birth and residence," plea adds.
Further, courts are not only adopting different normsand procedures for case registration and using different judicial terms, phrases and abbreviations, but are also taking different court fees, which is against the rule of law and right to justice, the plea asserts.
The PIL, therefore, makes the following prayers:
a) direct the Law Commission of India to prepare a comprehensive report on Uniform Judicial Code in consultation with the High Courts in order to make judicial terms, abbreviations, norms, phrases, court fee structure and case registration process uniform;
b) direct the Law Ministry to take appropriate steps to prepare a comprehensive report on Uniform Judicial Code in consultation with the High Courts;
c) constitute an Expert Committee to prepare a comprehensive report on Uniform Judicial Code in consultation with the High Courts.
