The bench of Justices Ajay Rastogi and Vikram Nath dismissed a review petition on 13th December 2022 filed by Bilkis Bano challenging the Supreme Court order dated 13th Mat 2022 which had held that remission of the convicts who raped her should be considered for remission as per the policy existing at the time of conviction in the State where the crime was actually committed.
It was contended by her in the petition that the remission policy of the State of Maharastra should apply in the present case, instead of the 1992 remission policy of Gujarat since the trial in the case has concluded in Maharashtra.
The Supreme Court by its order dated 13th May said that the crime was committed in the State of Gujarat and ordinarily the trial was to be concluded in the very same state and in terms of Section 432(7) CRPC, the appropriate Government is the Government of Gujarat in the ordinary course of nature.
