Bhima Koregaon case: Supreme Court has grants NIA access to the health records of activist Gautam Navlakha

On Friday, October 21, 2022, the Supreme Court of India allowed the National Investigation Agency and other parties to review the reports filed by the "Jaslok Hospital" regarding the Bhima Koregaon case accused Gautam Navlakha's health status.

The 73-year-old human rights activist, who was detained after being arrested in August 2018, has now sought the Supreme Court's help, after the Bombay High Court denied his appeal. He claimed that he had a number of debilitating conditions, such as skin allergies and dental problems, and that he needed a colonoscopy to rule out any potential malignancy. In order to be placed under house arrest, he asked to be moved to his sister's home.

On September 29, the Supreme Court passed an order directing that Navlakha be sent to a facility of his choice for a comprehensive medical examination. Senior Advocate Kapil Sibal argued that Navlakha had numerous health issues. Additionally, the hospital was requested to provide the court with a report based on the examination.

A bench of Justices KM Joseph and Hrishikesh Roy was considering a petition moved by Navlakha seeking transfer to house arrest and held "The parties are granted liberty to inspect the medical reports sent by the (unclear) hospital."

SG Tushar Mehta said that "Navlakha is getting treatment, and routine check-ups are ongoing."

The Bench indicated the hospital reports, saying that "how many have been given them, it might not be feasible for them to read them all at once". The bench further held, "Also, the larger issue relating to his entitlement to house arrest will be considered later."

Solicitor General Tushar Mehta urged that the matter be taken up on November 2 at the brief hearing today. The case will now be heard again on 09th November.
