The Bar Council of India (BCI) informed the Delhi High Court on December 7 that the All India Bar Examination (AIBE) would be held on February 5 and the results would be announced in April.
The entire period between October 2021 and April 2023 (when AIBE was not held) would not be counted as part of the required two-year time period to pass the exam, according to a BCI resolution dated December 30, 2022.
The BCI made these submissions in response to a petition filed in Delhi High Court by a lawyer named Nishant Khatri.
According to the petition, despite being admitted to the Delhi Bar Council in November 2019, he should not be barred from practising because the AIBE exams will not be held after October 2021.
Justice Prathiba M Singh presided over the hearing, having previously stated that Khatri could not be barred from practising.
The court had ordered the BCI to file a status report and reveal the next AIBE exam date. The BCI was also asked to think about creating a set schedule for AIBE.
The issue of a set schedule will be addressed at the BCI's next meeting, according to the organisation.
Following consideration of the submissions, Justice Singh adjourned the case until May 4.
