Allahabad HC Urges Media Restraint in Krishna Janmabhoomi-Shahi Idgah Case, Warns of Contempt for Misreporting

The Allahabad High Court has issued a significant directive urging the media to "observe due restraint" while reporting on the Krishna Janmabhoomi-Shahi Idgah case. The court expressed concerns that misrepresentation of the proceedings could undermine the sanctity of judicial processes.

It emphasized that inaccurate or irresponsible reporting may invite contempt proceedings, reflecting the judiciary's firm stance on preserving the dignity of its orders and processes.

The case, which involves multiple suits regarding the disputed Krishna Janmabhoomi temple and Shahi Idgah Mosque in Mathura, has garnered substantial public and media interest. On November 28, the court considered several petitions and applications, with arguments and procedural requests presented by counsel from both sides.

During the hearing of one specific case (OSUT 18 of 2023), Advocate Hare Ram Tripathi highlighted concerns about misreporting in both electronic and print media, warning of its potential to mislead the public and distort judicial proceedings. Other parties echoed these concerns, urging the court to establish stringent guidelines for responsible media reporting. While the court stopped short of imposing a blanket prohibition, it underscored that any reporting which distorts the factual essence of the case could be deemed contempt of court.

Justice Ram Manohar Narayan Mishra, presiding over the bench, remarked that media coverage must not compromise the integrity of judicial proceedings. To prevent violations, the court directed its Registrar (Compliance) to circulate its observations and warnings to all concerned parties.

The case is scheduled for further deliberation on December 4, 2024. The consolidated suits under OSUT 1 of 2023 address disputes over ownership and related claims concerning the Krishna Janmabhoomi temple and Shahi Idgah mosque. Several petitions linked to the matter are also being reviewed by the Supreme Court.

In addition to addressing media concerns, the High Court dealt with procedural matters during the hearing. It granted an adjournment in the lead case at the defendants' request, citing ongoing proceedings in the Supreme Court. The plaintiffs' advocates opposed the adjournment, highlighting the pendency of amendment applications in related suits.

The consolidated suits involve deliberations on both procedural issues and substantive property rights claims. The court directed the parties to ensure the timely exchange of documents, signaling its intention to streamline the litigation process.
