Allahabad HC Slaps ₹1 Lakh Fine on Petitioner for 'Gross Misuse of Law'

The Allahabad High Court recently rejected a review application and imposed a fine of ₹1 lakh on the petitioner, citing what the court described as a "gross misuse of the legal process."

The order, issued by Justice Neeraj Tiwari's bench, highlighted that the petition lacked merit and included unfounded allegations against senior advocates and judicial officers.

The review application, filed by Randhir Kumar Pandey, contested a previous order from May 8, 2024, which granted him one year to vacate a shop he had been renting since before 1950. This decision followed a rent case initiated by the shop's landlord, Purushottam Das Maheshwari, under Section 21(1)(a) of the Uttar Pradesh Urban Building (Regulation of Letting, Rent, and Eviction) Act, 1972. The case, initially decided in Maheshwari's favor in 2008, had been upheld through various appeals and petitions, with the most recent dismissal by the high court in May 2024.

Pandey, who represented himself, alleged that his counsel, Senior Advocate D.P. Singh, had acted contrary to his instructions by requesting the court to dispose of the case without addressing its merits. Pandey contended that Singh had exceeded his authority by seeking a one-year extension to vacate the shop, rather than pursuing the legal battle further. However, the court found these allegations to be unsupported by any affidavit or evidence, dismissing them as vague and unfounded.

Justice Tiwari also addressed the serious and baseless allegations Pandey made against various advocates including Senior Advocates D.P. Singh and Atul Dayal, as well as several judges from the Kanpur Nagar judiciary. The court characterized these allegations as an attempt to tarnish the reputation of both the judiciary and the legal profession.

Despite the seriousness of Pandey's conduct, the court refrained from initiating criminal contempt proceedings against him, citing his advanced age (77 years) and health issues. Instead, the court imposed a fine of Rs 1 lakh, to be deposited within 15 days with the High Court's Legal Services Committee. Should Pandey fail to pay the fine, the District Magistrate of Kanpur Nagar has been directed to recover the amount as arrears of land revenue.
