The bench headed by Justice Ram Manohar Narayan Mishra issued the bail order while hearing Haroon’s revision plea, considering his incarceration since July 2023 and the significant backlog of pending cases, which may delay the resolution of his appeal.
Haroon had been sentenced to four years for offenses under Sections 354, 354A(1)(IV), 354D, and 509 of the IPC, including harassment and stalking of the judge.
The counsel argued the charges were exaggerated and noted his lack of evidence of private communication with the judge.
Despite the state’s objection, highlighting the severity of the allegations, the court granted bail, taking into account the time Haroon had already served and the potential delays in his case's resolution. This decision reflects the judiciary's careful balance between addressing crimes against women and ensuring procedural fairness for the accused.
