Allahabad HC directs State Government Response Over Alleged Notary Appointment Irregularities

Allahabad High Court, by notification dated May 29, 2023, has sought response from the state government on the petition filed against ignoring the reservation rules in notary appointment and has been directed to present the petition for hearing on January 12, 2024.

This order has been given by the division bench of Justice MC Tripathi and Justice Prashant Kumar while hearing the petition of Ramchandra Singh. Petitioner's advocate, Yogendra Kumar Yadav, says that earlier on March 7, 2007, Special Secretary Additional Legal Counsel had ordered the District Judge of Sonbhadra to appoint a notary as per reservation rules.

Apart from this, in the advertisement for an appointment to the post of Notary on October 26, 2021, the appointment was made at the district level as per the reservation policy. As of May 29, 2023, reservation rules have not been implemented in notary appointments at the state level. This is a violation of the Constitution. He presented some court precedents in his favor.

On behalf of the state government, Additional Chief Standing Advocate Ambrish Shukla said that the appointment of a notary is not a job. Notaries are bound under Rule 8 of the Notary Rules of 1956 and Section 2D of the Notary Act of 1952. He cited the decision of the Supreme Court.

The court considered the issue worthy of consideration and sought a response from the state government on the petition.
