Adult is free to marry or live with person of his/her choice : Allahabad HC

Recently, the single-hedaed bench of Justice Surendra Singh of the Allahabad High Court held that ''An adult is free to marry or live with a person of his/her choice and no one, including their parents or anyone on their behalf, can interfere in their right to freedom of choosing a partner''

The court asserted that this liberty originates from the Constitution's guarantee of the right to life and personal freedom.

In a recent judgment, Justice Surendra Singh, while addressing a petition submitted by an interfaith couple in a live-in relationship, ruled that in the event of any disruption to the petitioners' harmonious living, they should seek assistance from the relevant superintendent of police by presenting a copy of the order to secure their protection.

In their plea, the Muslim woman and her Hindu live-in partner requested that their family members be instructed not to disrupt their peaceful living. They also sought police protection through their petition.

The counsel representing the petitioners argued that both individuals are adults and have willingly entered into a live-in relationship. Furthermore, they highlighted that the woman's mother and her family strongly oppose the idea of this live-in relationship.

The woman's mother and other family members are purportedly causing harassment and disrupting the petitioners' tranquil life. The petition asserts that she has even issued threats to the petitioners, warning of severe consequences.

On August 4, the woman sought protection from the Gautam Budh Nagar Commissionerate police commissioner, but her request did not yield any favorable response.
