Rahul Gandhi has approached the Supreme Court against the decision of Gujarat High Court and it seems Congress leader is currently caught in a big political crisis. In the Modi surname case, he has neither got relief from the Sessions Court nor from High Court. In such a situation, now Rahul Gandhi has moved to the Supreme Court. A petition has been filed on his behalf on Saturday, what has been mentioned in that application has now come to the fore.
Congress leader Rahul Gandhi's biggest contention in his petition is that his eight-year career will be directly ruined. He does not consider this matter so big, in such a situation he should not be given such severe punishment. It is important to understand here that under Section 8(3) of the Representation of the People Act, if someone gets a sentence of more than two years, then he cannot contest elections for 6 years.
It has also been contended on behalf of Gandhi that the allegation made by the petitioner is not that serious and it is not right for him to get such harsh punishment. A plea was made on behalf of the Congress leader in the High Court with the same arguments, but then there was no relief.
The High Court had bluntly said that the conviction of Gandhi could not be stayed. It was made clear that there was no need to interfere with the judgment of the trial court. Gandhi's petition was dismissed on the same grounds. This matter is related to 2019 when Rahul Gandhi gave a controversial statement regarding the Modi surname during an election campaign.
In the statement, Gandhi had said, ... what is it that all thieves have Modi as their surname." Objecting to Rahul Gandhi's statement at an election rally in Karnataka, Gujarat BJP leader and MLA Purnesh Modi had filed a defamation case. Purnesh Modi had alleged in his complaint that through this statement, Congress leader Gandhi had hurt the sentiments of the entire Modi community, not any particular person. The statement has hurt the respect of the people of Modi community in the society.
