The bench of Justices Surya Kant and PS Narasimha granted bail to a woman who was accused of killing 7 in total including 3 sisters, 2 minor children and 2 fetuses.
The woman who has been extended the benefit of bail by the Apex Court was charged under sections 302, 304B, 306, and 498A IPC. Three sisters married to three brothers committed suicide along with their two children aged 4 and 22 days while two of them were pregnant for 8 months and 9 months in Dudu town of Rajasthan.
High Court dismissed the bail of the sister-in-law of the deceased girls/petitioner while observing the severity of the offence. The Supreme Court granted bail to the woman while reasoning the delay in trial and the role attributed to the woman in the charge-sheet.
Ardhendumauli Kumar Prasad, Sr. Advocate assisted by AOR Rishi Matoliya argued before the Supreme Court that the petitioner also falls on the same pedestal as the deceased woman. she is also a daughter-in-law of the family.
The advocate appearing for the State of Rajasthan argued that there are specific roles attributed to her for the demand of dowry.
