45 anticipatory bail application dismissed by Allahabad High Court judge in one day by stereo typed order: Supreme Court calls for a report from Registrar

A Supreme Court Division Bench comprising of justice Ajay Rastogi and CT Ravikumar recently on 21.10.2022 called upon the Registrar of Allahabad High Court seeking a report with reason from the concerned High Court Judge for his peculiar conduct while dismissing 45 petitions seeking anticipatory bail on a single day in the same fashion for non-prosecution.

The Top Court was hearing a petition for Special Leave challenging the High Court's order which dismissed the anticipatory bail application of the applicant and such other 44 petitioners on 29th September 2022.

The court said " "We are not supposed to comment at this stage but direct the Registrar of the High Court of Allahabad to submit the report to this Court after obtaining from the concerned Judge (Krishan Pahal,J.) as to what prevailed upon him in passing the orders consistently almost in 45 matters at a given point of time on the same date dismissing them in the same fashion for non-prosecution, that too when one has approached the Court for protecting his liberty which is sacrosanct under Article 21 of the Constitution."

Deprecating the High Court Judge's working style, the bench remarked, "This kind of approach in passing orders is not acceptable by this Court at any cost". 

The Court hearing an Anticipatory bail application of the petitioner for the offence punishable u/s 420, 406, 504, 506, 307, 323 IPC passed this order and also issued notice to the State of Uttar Pradesh and stayed his arrest.

The next date of hearing in the case is on 25th November, 2022.
