2011 Pune Murder Case: SC grants bail to Accused

The Supreme Court has decided to release a prisoner who had been serving a life sentence for murder. This decision comes after the individual spent over 11 years behind bars following a conviction in a lower court.

A division bench of Justices Abhay S Oka and Pankaj Mithal ordered that convict Dinesh alias Paul Daniel Khajekar be released on bail pending final disposal of the appeal by the Bombay High Court. Dinesh was arrested on October 29, 2011, when he was 20 years old. In fact, a person had died during a scuffle between the accused and others, for which he was sentenced. According to the convict's lawyer, he is currently 32 years old and his appeal is pending in the High Court for the last six years.

He had moved the apex court after the Bombay High Court, in its order dated February 7, had refused to suspend the convict's sentence. The High Court should have granted relief to the appellant under Section 389 of the Code of Criminal Procedure, 1973.

"Accordingly, the appellant (Dinesh) will be granted bail pending final disposal of the appeal in the High Court," the top court said in its order dated September 25. Section 389 of the CrPC allows the court to suspend his sentence. The hearing of the accused's appeal is pending and he may be released on bail.

The top court directed Khajekar to appear before the trial court to complete the bail formalities and said he will be granted bail on appropriate terms and conditions. Advocate Sana Raees Khan, appearing for Dinesh, argued that there are three interested eyewitnesses in the case and no independent witness was examined. However, the crime allegedly took place in a public place.

Khan submitted that two eyewitnesses have stated in their cross-examination that when they reached the spot, they saw the deceased soaked in blood, which establishes the fact that they had not seen the incident. According to the prosecution, an FIR was registered on October 29, 2011, on the complaint of Tushar More that his brother Tanmay More, who worked at the Ganesh Lottery Center in Pune, was allegedly killed in a clash with Dinesh and others. .
