100 Years of Illegal Occupation Does Not Establish Right Over Kolkata Port Trust Land: Calcutta HC

The Calcutta High Court ruled on a case involving the illegal occupation of Kolkata Port Trust land, emphasizing that the mere act of occupying land illegally for a century does not confer any legal right to ownership.

The case concerns the illegal occupation of Kolkata Port Trust land in the Majerhat area of Kolkata. A lawsuit was brought before the High Court regarding this matter.

Justice Amrita Sinha, sitting on a single bench, issued a directive to remove any unauthorized construction on the land in question.

When the police arrived to remove the illegal construction, they encountered resistance from local residents affiliated with the unauthorized building. Those involved in the illegal construction challenged the single bench's decision on the division bench, arguing that construction had been ongoing at the site for several years.

In response, the division bench comprising Chief Justice TS Sivagananam and Justice Hiranmoy Bhattacharya expressed dissatisfaction, emphasizing that occupying land for a century does not grant ownership rights.

The division bench has directed the state government and Kolkata Port Trust to submit affidavits addressing this issue.
